§ 1-2. Definitions.

  • The following words, terms and phrases, when used in this Code or other ordinances of the city, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    AS. Whenever the abbreviation "AS" is used, it shall refer to the official Alaska Statutes, including the latest edition, amendments and supplements.

    City. The term "city" means the City of Tanana, Alaska, or the area within the territorial limits of the city.

    Clerk or city clerk. The term "clerk" or "city clerk" means the city clerk of the City of Tanana, Alaska.

    Code, this Code, or Code of Ordinances. The term "Code," "this Code," or "Code of Ordinances" means the Code of Ordinances, City of Tanana, Alaska, as defined in this section.

    Computation of time. The time within which an act is to be done is computed by excluding the first day and including the last, unless the last day is a holiday, and then it is also excluded.

    Council or city council. The term "council" or "city council" means the city council and the governing body of the City of Tanana, Alaska.

    Delegation of authority. Whenever a provision appears requiring the head of a department or some other city officer or employee to do some act or perform some duty, it shall be construed to authorize the head of the department or other officer or employee to designate, delegate and authorize subordinates to perform the required act or perform the duty, unless the terms of the provision or section specify otherwise.

    Department; city council; agency. The name or title of any department, city council, or agency, unless specifically stated otherwise, shall be read as though the words "of the City of Tanana, Alaska" were added thereto.

    Governing authority or governing body. The term "governing authority" or "governing body" means the city council of Tanana, Alaska.

    Joint authority. Whenever a joint authority is given to three or more persons or officers, it shall be construed as giving such authority to a majority of them.

    Law. The term "law" means and denotes applicable federal law, the state constitution and statutes, this Code, ordinances and resolutions of the city, and, when appropriate, any and all rules and regulations that may be promulgated thereunder.

    Oath. The term "oath" means and includes an affirmation or declaration.

    Officer, office, board, commission, department. Whenever any officer, office, board, commission or department is referred to, it shall mean an officer, office, board, commission or department of the city.

    Or, and. The term "or" may be read as "and," and the term "and" may be read as "or," where the sense requires it.

    Ordinance. The term "ordinance" means a legislative act of the city council of a general and permanent nature.

    Person. The term "person" means a corporation, company, partnership, firm, association, organization, business, trust, or society, as well as a natural person.

    Public place. The term "public place" means any park, cemetery, shopping center, schoolyard, or open space adjacent thereto, or any area available accessible to the public, regardless of whether privately or publicly owned, and any place that the public is invited or permitted to go or to congregate.

    Publish. The term "publish" means to post a notice within the city in three locations open to the public, one of which shall be the city offices, for a period of not less than five days.

    Resolution. The term "resolution" means a legislative act of the city council of a special or temporary character.

    State. The term "state" means the State of Alaska.
