§ 26-81. Hearing and determination.

  • (a)

    At the hearing, the platting board shall consider the alteration or replat and make its decision on the merits of the proposal. No vacation of a city street may be made without the consent of the city council.

    (b)

    The board may act only upon a majority vote of its entire voting membership. Only those members of the platting board who have been present at the hearing may vote upon the question presented.

    (c)

    The city council shall have 30 days from the decision in which to veto the board decision. If no veto is received by the board within the 30-day period, the consent of the city shall be considered to have been given to the vacation.
