§ 40-23. Registration and certain safe equipment required.

  • (a)

    Each vehicle shall be registered with the department of public safety and a numbered sticker or tag shall be displayed prominently on the vehicle. Any vehicle not displaying said sticker or tag while operating on the streets and roads of the city shall be in violation of this subsection and the owner shall be fined for the set price of said registration. This fine shall pay the costs of the registration of the vehicle.

    (b)

    Each motor vehicle operated within the city shall be equipped with minimum safety equipment. Each vehicle shall be inspected once upon registration for compliance with the safety provisions of this chapter before a sticker or tag is issued. Continued compliance with safety provisions will be the responsibility of the operator.

    (c)

    All off-road vehicles shall be equipped with adequate brakes. These vehicles shall also be equipped with attached functioning headlights, taillight or reflective sticker.

    (d)

    All other vehicles shall be equipped with functioning headlights, brakes and taillights.

    (e)

    All violations under this section shall be correctable offenses. If proof is provided that the offense has been corrected before the arraignment date provided on the citation, the citation shall be null and void. If no such proof is provided, the offender must appear at arraignment. Any persons who appear at arraignment as a result of this subsection shall be fined as deemed appropriate by the magistrate. This fine shall be payable to the city.

    (f)

    Any city registration sticker or tag which is covered, altered, or mutilated shall be deemed void, and the vehicle for which the sticker or tag was issued shall be considered in violation of this section.

    (g)

    Fees for registration shall be set by resolution of the city council.

    (h)

    The village public safety officer shall enforce the provisions of this section.
